Divorce for Dummies

Man divorces his wife of 11 years and mother of 3 children in SLEEP - yes he divorced her while he was sleeping - and the local islamic leaders (?) said that the divorce is valid !!! An Islamic scholar stepped in and said that the imam was wrong in interpreting the Muslim law for divorce as one cannot divorce his wife in a state of intoxication/compulsion or can divorce only when fully in his senses - i.e. not sleeping, drinking, no gun to the head (more about this later) etc.

Good point by the scholar in bringing that to our notice and potentially "saving" the woman from getting divorced. This though, does not do a lot for the guy's marriage-worthiness because every wife he "sleeps" with risks getting divorced { yahoo icon :-O }

Anyway, two things need to happen here:
1. The man deserves to be kicked between his legs because why the hell would anyone do such a thing..divorcing your wife in sleep? What was he thinking or was he thinking? But but, isn't this an indication of what this guy was thinking when he was awake? Woman - next time he goes to sleep, strangle him for us please

2. A common law needs to be implemented in this country, be it a Hindu or a Muslim or a Christian. Not because divorcing your wife in sleep is stupid but because the very practice is primitive. More importantly, when you have a law which can be interpreted in 10 different ways depending on the whims and fancies of one-track minds, it has to change.

Please don't see this as hate speech, because I haven't even started ;-) - kidding, but being "liberal" does not mean that we accept the status quo or stop questioning what we perceive as wrong. You might see such things going forward, depends entirely on what my whims and fancies are at that moment :-)

Could not come up with an appropriate title for the post - so suggestions are welcome. Or maybe we could write a book: 101 ways to divorce your wife - and feel stupid

Yes saw the news today and was not sure should I laugh or cry. I totally agree with you that there should be common law but this is not a cure for everything. I do not believe this problem will go away just by changing law. People should be educated and law should not be taken literally but by the deep meaning behind it. Even in our common law and justice system we see daily so many loopholes and so many people mis-utilizing, or, bending it. Few example can be Amarmani tripathi case, Jessica Lal... Just open the newspaper and you can see what I mean. Even we do not hesitate once to bend it if we get chance. How many of you not broke it time to time for example when you first time drive a bike did you had the Learning License :-.)Problem lies with our respect to law. I think to improve the situation following should be done.
1. Implement the common law
2. Educate people
3. Work on removing the corruption
4. Improve our juridical process so law should be swift and proper

Three investigators......i loved them, jupiter, pete and bob, if i remember correctly.

The whole concept, the secret office in the junkyard, the whole lot....man..those were some good summer vacations..:)

Divorce laws in India are primitive. From a personal experiance I can tell you If a gorl wants divorce she can get it, but if a boy want it, He and his family members will have Dowry case against them and Divorce What is that?

Too many comments already, but according to our rules I'm fourth. Not bad at all. Its getting better.

Now about the post. We do need to come up with laws which are universally applicable irrespective of religion, cast or creed. The scholar did a fine job in clarifying the things.

@Johnny Hotwire: Agree with you completely. It comes out of our lack of respect for the law. And the rich get away. Lately, the authorities are doing some showbaazi trying to get some paisawallahs in the dock but once this fades from public memory...:(

@bharath: this is exactly when they all go to sleep. Activists react only when there is rape or murder, divorce in sleep which actually points to a much more serious problem will be left untouched. There's religious sentiments at work :-)

@harsh: Some laws are skewed towards protecting women, and I wouldn't disagree with those. They need more protection because we men have given enough reasons to come out like crooks. But the women don't really come out of this smelling like roses and the law needs to take a careful view. For instance, if a married woman does something to herself, the husband/in-laws are taken into questioning and treated like potential criminals. I know a case where the in laws are great people, the guy is married to this girl (obviously) and she has some problems up in the head. She creates hell for everyone in the house, even abuses her in laws, but god forbid if someone tries to touch her, she goes to the kitchen and threatens to do something to herself. The parent-in-laws have no choice but to tolerate it because whatever they do, they get screwed. :(
@horizon: yes. He did it at the right time too. Or you can imagine the consequences :)
@chatterbaiiii: non violence pleease :) Poor guy became a porn star for a while !! Not so poor after all ;-)

I totally agree with You TCP they need protection, these laws were created to prote ct women but I think women have started to use these as weapon against everyone (inlaws) . I once met a COP who said this to me," I know you are right, You bring god as your witness that You are right, but if the girl says you are wrong then I have to find you wrong cause if I don't girl will start to say that I am corrupt and will be suspended immidiately". Tell me how many girls are found wrong in divorce/ dowry cases. I cannot believe that though population wise India is 55% male and 45% female (Some one told me this) 100% of male in these cases are wrong and 100% of female are right.

Would love to hear input on this from You guys.

@harsh: I understand but that's how it is going to be until we mature to a level where law is implemented based on simply the fact that a law was broken and not who the perpetrator/victim was
